Terms of Service

The rules for using the TexasParcels marketplace, parcel enrichment workflows, and listing services.

1. Acceptance of Terms

Welcome to TexasParcels. These Terms of Service ("Terms") govern your access to and use of the TexasParcels website, marketplace, parcel enrichment workflows, and related services (collectively, the "Services"). By creating an account or otherwise using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

2. Who We Are

TexasParcels is a Texas-focused land marketplace. Our Services help landowners, buyers, brokers, and real estate professionals review, enrich, market, and discover Texas parcels using GIS-ready context such as parcel boundaries, imagery, floodplain context, terrain, and other mapped land data.

3. Accounts

To access certain features you must create an account. You may sign in with email and password or use a supported identity provider (Apple or Google). You agree to:

  • Provide accurate and current information and keep your profile complete.
  • Keep your credentials confidential and notify us promptly of any unauthorized use.
  • Be responsible for activity on your account.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a security or compliance risk.

4. Permitted Use

You may use the Services only for lawful purposes related to reviewing, marketing, and transacting Texas land. You agree not to:

  • Scrape, harvest, or bulk-download parcel data, listings, imagery, or GIS layers without our written consent.
  • Misrepresent property attributes, ownership, pricing, or your identity in any listing or inquiry.
  • Use the Services to harass, defraud, or harm any person.
  • Reverse engineer, interfere with, or attempt to gain unauthorized access to the Services or related systems.
  • Upload content that infringes intellectual property or other rights, or that violates applicable law.

5. Listings, Enrichment, and Seller Responsibilities

If you publish a parcel listing or order parcel enrichment, you represent that you have the right to do so and that the information you provide is accurate. You are solely responsible for:

  • Land facts you describe (acreage, frontage, access, water, structures, encumbrances).
  • Pricing, availability, and your communications with potential buyers.
  • Compliance with applicable real estate, advertising, and disclosure laws for Texas land.

TexasParcels provides GIS-derived context as an informational aid. Buyers and sellers should independently verify critical attributes with the appropriate public records and professionals before transacting.

6. Plans, Pricing, and Payments

TexasParcels offers paid packages, which currently include:

  • Analyze Land — parcel-ready GIS enrichment for early land review and due diligence.
  • Analyze + Marketplace Listing — enrichment plus a buyer-ready listing on the marketplace.
  • Featured Listing — everything in the listing package plus stronger placement and priority visibility.

Prices, inclusions, and packages may change. Current pricing is displayed in the Services. Payments are processed by our payment provider. Unless otherwise stated, fees are non-refundable once enrichment or listing services have been delivered. Featured placement durations are described at purchase.

7. Intellectual Land

The Services, including software, design, mapping presentation, and proprietary enrichment outputs, are owned by TexasParcels or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.

You retain ownership of the listing content you submit (descriptions, images, parcel details). By submitting content, you grant TexasParcels a worldwide, royalty-free license to host, display, format, and promote that content as needed to operate the Services.

8. GIS and Public Data Disclaimer

Parcel boundaries, imagery, floodplain context, terrain, and other GIS attributes are derived from public records, government datasets, and partner sources. They are presented for informational purposes, may be approximate, and may not reflect the most current public records. They are not a substitute for a survey, title report, appraisal, or legal advice.

9. Third-Party Services

The Services rely on third-party providers for authentication (including Apple and Google), hosting, analytics, payment processing, email delivery, and mapping. Your use of those features is also subject to the relevant third-party terms. We are not responsible for third-party services.

10. Suspension and Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms, if we are required by law, or if we discontinue a feature. You may stop using the Services at any time and request deletion of your account by contacting us. Some content (for example, public listing data referenced by third parties) may persist outside our control after deletion.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GIS-DERIVED INFORMATION WILL BE COMPLETE OR ACCURATE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXASPARCELS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless TexasParcels and its affiliates from any claims, damages, or expenses arising out of your listings, your content, your violation of these Terms, or your violation of any rights of another.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. You and TexasParcels agree to submit to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute that is not subject to arbitration or small claims court.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and, where appropriate, notify you through the Services. Continued use after changes become effective constitutes acceptance of the updated Terms.
